An Indian man, who came to Australia in 2008 on a student visa and later got married to an Australian citizen, has to leave his wife and son and return to India after his application for a permanent residency was refused.
Harpreet Grewal, 32, applied for a provisional spouse visa in September 2012. An applicant must be on this visa for at least two years before they can apply for permanency. The couple separated for about 10 months, which the Immigration Department became aware of and thus rejected his application.
Mr Grewal says the Immigration Department thinks he and his wife had only been living together for 16 months when, in fact, he says, they had been under the same roof for almost five years.
Authorities, on the other hand, believe they were only together to gain him permanent residency.
